These Terms of Service (“Terms”) govern access to and use of the website https://think-cloud.digital/ and the Think Cloud software described on that website. By using the website or software, you agree to these Terms. If you do not agree, do not use the website or software.

1. Acceptance of terms

By browsing the website or using the software, you confirm that you understand and accept these Terms, together with the Privacy Policy. If you use the software on behalf of an organization, you represent that you have authority to bind that organization.

2. Description of the software

Think Cloud is solely a local data tracking utility and analytical software for Offline Wallet Tracker for Personal Wallet Archive Oversight. It is designed to help users organize locally available information, track records, review historical data, analyze informational entries, and maintain personal record-keeping.

Think Cloud is not a financial institution, wallet provider, custodian, broker, exchange, investment platform, payment provider, or financial advisory service. The application does not hold, hold custody of, or process user funds or cryptocurrency assets, does not access private keys, does not execute transactions, and does not provide financial or investment advice. All information is provided for informational and record-keeping purposes only.

3. Permitted use

You may use the website for lawful informational purposes and may use the software for personal, informational archive oversight and record-keeping consistent with these Terms and applicable law.

4. Prohibited use

You agree not to:

  • use Think Cloud to misrepresent it as a bank, exchange, custodian, broker, or investment service;
  • attempt to use the software to execute transfers, trades, or payments it does not provide;
  • upload or transmit malware, or attempt to disrupt the website;
  • scrape the site in a way that impairs service, or use automated means to create artificial traffic;
  • infringe intellectual property or privacy rights of others;
  • use the website or software for unlawful, fraudulent, or deceptive purposes.

5. Intellectual property

Site content, branding, layout, and related materials are owned by Think Cloud or its licensors unless otherwise stated. You receive a limited, revocable, non-exclusive right to access the website for personal informational use. You may not copy, modify, or redistribute site materials for commercial publication without prior written permission, except for brief quotations with attribution where fair dealing / fair use applies.

6. Software limitations

The software is an analytical and record-keeping utility. Features focus on organizing, tracking, reviewing, and summarizing informational data. Think Cloud does not guarantee uninterrupted operation, error-free output, or fitness for any particular archival outcome. You are responsible for verifying the accuracy of records you maintain and for keeping backups you control.

7. Third-party services

The website may link to third-party sites, including https://apps.microsoft.com/. Third-party services are not controlled by Think Cloud. Availability, pricing, and policies of third parties may change without notice. References to the Microsoft Store are for distribution navigation only and do not imply that Microsoft published, verified, certified, developed, endorsed, or partnered with Think Cloud unless separately and factually established.

8. No financial or investment advice

Nothing on the website or in the software constitutes financial, investment, tax, accounting, or legal advice. You should consult qualified professionals before making decisions that involve money, assets, or regulated activities.

9. No financial institution status

Think Cloud does not claim banking, payment-institution, securities, or other financial regulatory licenses through these Terms. Presentation of an office address and contact details does not create a financial services relationship.

10. No wallet functionality; no custody; no transaction execution

To avoid doubt:

  • Think Cloud does not provide cryptocurrency wallet custody functionality;
  • Think Cloud does not take custody of user assets;
  • Think Cloud does not execute financial or cryptocurrency transactions;
  • Think Cloud does not access private keys.

11. Obtaining the software

Primary distribution referenced on this website is via the Microsoft Store homepage. This website does not offer EXE, MSI, ZIP, or other direct installer downloads. You are responsible for reviewing store terms that apply when you obtain software through Microsoft’s properties.

12. Disclaimer of warranties

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE WEBSITE AND SOFTWARE ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. 13. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THINK CLOUD AND ITS CONTRIBUTORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR BUSINESS OPPORTUNITY, ARISING OUT OF OR RELATED TO YOUR USE OF THE WEBSITE OR SOFTWARE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. These Terms are governed by the laws of Thailand (TH), without regard to conflict-of-law principles that would require application of another jurisdiction’s laws, except where mandatory consumer protections in your country of residence apply and cannot be waived.
